1. Website Terms of Service

These Terms of Service ("Terms") govern your access to and use of bookbagmedia.com (the "Site") and any Bookbag services made available through it. By using the Site you agree to these Terms. If you do not agree, please stop using the Site.

1.1 Who we are

Bookbag Media Ltd ("Bookbag", "we", "us") is a company registered in England and Wales. You can contact us at hello@bookbagmedia.com.

1.2 Using the Site

You may use the Site for any lawful purpose. You must not:

Some parts of the Site require an account (for brands, schools, and Bookbag staff). You are responsible for keeping your account credentials secure and for all activity that takes place under your account. Tell us immediately at hello@bookbagmedia.com if you suspect unauthorised access. We may suspend or close accounts that breach these Terms, our Privacy Notice, or applicable law.

1.4 Intellectual property

The Site's design, code, copy, and branding are owned by Bookbag or our licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from the Site except as expressly permitted by us or by law.

Content you provide to Bookbag (brand logos, campaign copy, fulfilment photos) remains yours. You grant Bookbag a non-exclusive, royalty-free licence to host, reproduce, and display that content solely for the purpose of running the Bookbag service (including printing and distribution via our print partner and displaying confirmation photos to the sponsoring brand).

1.5 Privacy

How Bookbag collects, uses, and protects personal data is covered in our Privacy Notice. By using the Site you acknowledge that Notice.

1.6 No warranty

The Site is provided on an "as is" and "as available" basis. To the extent permitted by law, Bookbag disclaims all implied warranties, including fitness for a particular purpose, satisfactory quality, and non-infringement. We do not guarantee that the Site will be error-free, uninterrupted, or free of harmful components.

1.7 Limitation of liability

To the fullest extent permitted by law, Bookbag will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or in connection with your use of the Site. Our total liability for any claim arising in connection with your use of the Site is limited to the greater of £100 or the fees you have paid Bookbag in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

1.8 Third-party links

The Site may link to third-party websites we do not control. We're not responsible for the content, accuracy, or availability of those sites, and linking to them is not an endorsement.

1.9 Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged on the Site or communicated to affected users directly. The "Last updated" date at the top of this page always reflects the current version. Continued use of the Site after a change means you accept the updated Terms.

1.10 Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with the Site is subject to the exclusive jurisdiction of the courts of England and Wales.

2. Campaign terms (brands)

In addition to the Terms of Service above, these campaign-specific rules apply to every brand that creates and submits a campaign on Bookbag. The same list is shown inline during campaign creation so brands see the rules at the point of accepting them.

3. School fulfilment agreement

In addition to the Terms of Service above, these fulfilment rules apply to every school that accepts an invite to receive campaigns through Bookbag, and to every fulfilment confirmation the school submits. The photo rule is non-negotiable: photos containing children will be rejected and payment held until a compliant photo is uploaded.
